    What are consent orders?

    An agreement with the force of a court order.

    Property consent orders are written orders made by a court with both people’s agreement. They can set out how property, money, debts and superannuation will be dealt with after separation. The court must be satisfied that the proposed financial outcome is just and equitable.

    A few things to know before you start.

    Do we both need to agree?

    Yes. Consent orders record agreed terms. If key issues are unresolved or either person is unwilling to sign, work through that first. Our suitability check helps you find an appropriate next step.

    Is a lawyer included?

    SplitBase provides documents for self-filing and does not include lawyer review. SplitPlus includes lawyer review and filing. SplitPro adds a 60-minute consultation. Check the package details and any separate filing charge before you pay.

    Do consent orders also give us a divorce?

    No. Divorce and property consent orders are separate processes. A property order deals with the financial arrangements set out in it.

    How long does the process take?

    It depends on how quickly you both provide information, agree and sign, and on the court’s review. We do not promise a court approval date.

    Can we apply without attending a hearing?

    An agreed consent-order application can generally be considered on the documents. The court can request further information or changes. Independent legal advice can help you understand the consequences before signing.
